NOTICE OF SUBSTITUTE TRUSTEE'S SALE OF REAL ESTATE WHEREAS, by Deed of Trust recorded in the Register's Office for Campbell County, Tennessee, in Trust Deed Book 573, Page 500, on February 10, 2011, Gary R. Welden and Mildred Welden conveyed to Allyn M. Lay, Jr., Trustee, the hereinafter described real property, to secure the payment of a Promissory Note dated January 24, 2011 as last renewed on May 20, 2011, to First National Bank of Oneida in the original amount of One Hundred Twenty Thousand Eleven Dollars and Seventy Eight Cents ($120,011.78) Dollars to First National Bank of Oneida, all as fully set forth in said Deed of Trust and Promissory Note; and WHEREAS, by an Appointment of Substitute Trustee dated January 8, 2015, and recorded in Miscellaneous Book 116, Page 483, in the Register's Office for Campbell County, Tennessee, on January 22, 2015, Joseph G. Coker was appointed Substitute Trustee of said Deed of Trust in the place and stead of Allyn M. Lay, Jr.; and WHEREAS, default has been made in the payment of the above referenced indebtedness, and other provisions of the Trust Deed have been violated, and the legal holder of the Promissory Note secured by the said Trust Deed have declared the entire amount due and payable as provided in said Trust Deed, and the undersigned, as Substitute Trustee, has been directed to foreclose the aforesaid Trust Deed in accordance with the terms thereof, and the public is hereby notified that the undersigned Substitute Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for cash in hand, on the front steps of the Campbell County Courthouse in Jacksboro, Tennessee, at 12:30 P.M. on April 17, 2015, said property to be sold in bar of the equity of redemption. TRACT TWO: Situate in District Number One (1) of Campbell County, Tennessee, what is commonly called Pleasant Ridge community, and described as follows: Beginning on an iron stake 10 feet North of the Davenport and Archer Road; thence Northwardly 150 feet to a stake; thence running Eastwardly 100 feet to a stake; thence Southwardly 150 feet to within 10 feet of said road to an iron stake; thence running Westwardly parallel with said road to the beginning corner. This sale will be free from the equitable right of redemption under the laws of the State of Tennessee, homestead, dower and other exemptions, the same having been waived in said Trust Deed, and will be subject to all unpaid taxes and subject to any easements and restrictions or prior liens or mortgages of record, if any. If the highest bidder is unable to comply with the terms of the sale, I reserve the right to proceed to the next highest bidder able to comply or to re-advertise if I so choose. The right is reserved to adjourn the day of sale to another date certain without further publication upon announcement at the time set above. The holder of the Promissory Note shall have the right to bid at said sale. The Trustee is further aware of a Deed of Trust from Mildred Welden to Allyn M. Lay, Jr., Trustee, dated March 23, 2010, and recorded in Trust Deed Book 561, Page 1, in the Register's Office for Campbell County, Tennessee, on March 25, 2010, securing payment of a Promissory Note to First National Bank of Oneida in the original amount of $51,968.91. To the best of the Trustee's knowledge, information, and belief, there are no Federal or State tax lien claimants or other claimants upon the subject property which would require notice pursuant to the terms and provisions of T.C.A. 35-5-104 or T.C.A. 67-1-1433 or 26 U.S.C. 7425.
