NOTICE TRUSTEE'S SALE OF REAL ESTATE WHEREAS, on the 15th day of August 2008, by Deed of Trust recorded in the Register's Office at Jacksboro, Tennessee, in Trust Deed Book 533 at Page 943, LAVERN E. CLAIBORNE (A.K.A. LAVERNE CLAIBORNE), conveyed to DAVID REYNOLDS, TRUSTEE, the herein described real estate, to secure the payment of the following indebted-ness: one note of even date executed by LAVERN E. CLAIBORNE payable to PEOPLES BANK OF THE SOUTH, in the original amount of $35,709.78 and later modified by Modifica-tion Agreement in Misc. Book 111, Page 257 to secure a new note in the total amount of $37,118.72 and; WHEREAS, default has been made in the pay-ment of said indebted-nesses and other provi-sions of the Trust Deeds have been violated, and Peoples Bank of the South the holder of said indebtedness has de-clared the entire amount due and payable as pro-vided in said deed of trust, and the Trustee has been directed to fore-close the deed of trust. In accordance with the terms thereof, the public is hereby notified that the undersigned Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for cash in hand in front of the Courthouse door in Jacksboro, Tennessee, at the hour of 11:00 o'clock a.m., on the 6th day of September, 2019, said property to be sold in bar of the right and equity of redemption and all other rights and ex-emptions, and subject to the following conditions: unpaid property taxes and other prior encum-brances of record. Situate in District No. 3, Campbell County, Ten-nessee, and bounded as follows: Beginning on a stone at the E. corner of said land, at U.S. Highway No. 25 W. thence S.E. to the L&N R.R. to a stone, thence W. with the L&N R.R. right of way to a stone at the new survey, and or 4 lane highway, thence N.W. with the right-of-way of the new 4 lane survey to a stone, at the old U.S. No. 25 highway, thence east-wardly with the old U.S. No 25 Highway to the stone the beginning cor-ner, containing by esti-mation, one acre be the same more or less. There is EXCEPTED from the above de-scribed property that cer-tain tract of land re-corded in Deed Book 196, Page 87 and Deed Book 451, Page 15, in the Register's Office for Campbell County, Tennessee. For further reference, see Warranty Deed Book 442, Page 153, in the Register's Office for Campbell County, Tennessee Parcel ID No.: 103D-A-103D-016.00 The commonly known street address for the subject property is be-lieved to be: 1855 Old Jacksboro Hwy LaFollette, TN 37766 To the best of the Trustee's knowledge, in-formation and belief, there are no tax lien claimants upon the sub-ject property which would require notice pursuant to Tenn. Code Ann. #x00A7;#x00A7; 35-5-104 and 67-1-1433 (b)(1) and 26 U.S.C. #x00A7; 7425. To the best of the Trustee's knowledge, persons who have inter-ests in the subject prop-erty, other than the bor-rower and who are entitle to notice are: Pursuant to the above described Deeds of Trust, the Trustee may sell the property by lots or as a whole, whichever generates the highest overall bid. The pro-ceeds from the sale of the above-described property shall be applied in accordance with the provisions of the above-described Deed of Trust. Should the high-est and best bidder fail to comply with the terms of the sale, then the Trustee shall have the option of accepting the second highest bid, or the next highest bid, which the buyer is able to comply. The Trustee shall also have the right to adjourn the sale to another date certain without further publication but upon an-nouncement before or during the sale.
